1. Agreement to Terms
By accessing or using Dialio (the "Service"), operated by Dialio & Lalas, Nagaur, Rajasthan, India - 341509 ("we", "us", "our"), you ("you", "user", or "customer") agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, do not register or use the Service.
2. Service Description
Dialio provides AI-powered call answering, messaging, and omnichannel customer communication (including phone, WhatsApp, SMS, website chat and email) for businesses and individuals ("clients").
Prohibited use: You may not use Dialio for adult, illegal or any services violating applicable law. We reserve the right to reject or suspend use that we believe falls into these categories.
3. Accounts & Resale
Any individual or business may create a Dialio account.
You may resell or white-label Dialio's services to your own clients, provided you ensure compliance with these Terms.
You are responsible for all activity and content on your account and those you manage if you resell the platform.
4. Free Demo
Dialio offers a free demo (including designated trial minutes) for new users and prospects. Limits and eligibility are defined on our site or in promotional materials. Vocational restrictions, fraudulent activity, or misuse may result in suspension.
5. Payments, Billing & Refunds
- Services can be prepaid, pay-as-you-go, or billed via invoice.
- Prices, including taxes/fees, are set in the currency listed at purchase (most commonly INR or USD).
- All payments are due immediately unless invoiced, in which case the invoice will specify payment terms.
- No refunds for used or partially used services. Refunds for unused minutes/credits are at our discretion.
- In case of non-payment, your account may be suspended until payment is received.
6. Acceptable Use
You agree not to:
- Use the Service for prohibited content or illegal purposes.
- Attempt unauthorized access to the Service or its data.
- Use Dialio to harass, spam or defraud others.
7. AI Disclaimer
Dialio's AI is designed to provide accurate, human-like responses. However, due to the nature of AI, it may occasionally misunderstand callers, provide incorrect information, or miss context. You are responsible for monitoring critical interactions and should not rely solely on Dialio for life-critical or emergency communications.
8. Data & Recordings
- Call recordings, transcripts, and metadata are stored for your business operations.
- You may access, export, or use your data for your business only.
- We may use de-identified call transcripts to improve the AI agent (see Privacy Policy for details).
- On account termination, we do not automatically delete stored recordings/transcripts unless required by law.
9. Support
Support is available via email (contact@dialio.io), phone, WhatsApp, and website chat.
We aim to be responsive during business hours but provide no guaranteed support response times.
10. Suspension & Termination
We may suspend or terminate your account for fraud, abuse, non-payment, adult or illegal content, or breach of these Terms.
We reserve the right to investigate and notify authorities if required.
11. Service Availability
Dialio strives for continuous service but does not guarantee error-free, uninterrupted operation. Features and uptime are provided "as is" and "as available."
12. Limitation of Liability
Our liability is limited to the total fees paid by you in the 3 months preceding a claim. We are not liable for indirect, incidental, or consequential damages.
13. Changes to Terms
We may change these Terms at any time by posting updated terms on our website. Continued use after such changes constitutes your acceptance.
14. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts of Rajasthan, India.
